Terms of Service

These terms govern your use of Xhypee, operated by Xhypee Pty Ltd (ABN 66 701 748 049), trading as Xhypee. By creating an account or using the site, you agree to them. Every individual booking is additionally governed by our Rental Agreement, which covers the terms between a renter and an owner for that specific booking.

1. Who can use Xhypee

You must be at least 18 years old and able to form a binding contract to create an account. You're responsible for keeping your login details secure and for anything that happens under your account.

2. Xhypee is a marketplace, not a party to your rental

Xhypee connects renters and item owners and provides the tools to book, pay, and resolve issues safely — payment processing, identity verification, condition photos, and a dispute process. We are not the owner or renter of any item listed on the platform, and the rental contract itself is between the renter and the owner, governed by the Rental Agreement. We're not liable for the condition, safety, legality, or fitness for purpose of any listed item, or for the conduct of another user — though we do investigate reports and take action against accounts that misuse the platform.

3. Acceptable use

You agree not to:

• List anything illegal, unsafe, or that you don't have the right to rent out;
• Provide false information — about yourself, an item, or a booking;
• Harass, threaten, or abuse another user;
• Attempt to circumvent payments, fees, or the identity-verification process;
• Use automated tools to scrape, spam, or abuse the platform;
• Post spam or content that infringes someone else's rights.

We can remove content, suspend, or close an account that breaches these terms — including based on a user report (see the report option on profiles, messages, and listings).

4. Your content

You keep ownership of what you post — listing photos, descriptions, reviews, messages, feedback. By posting it, you give Xhypee the license needed to display, store, and distribute it as part of running the platform (for example, showing your listing photo in search results).

5. Fees

Xhypee charges a commission on bookings, shown in the price breakdown before you book or list. Fee schedules (late return, cancellation) are shown on the listing itself where they apply, and in the Rental Agreement.

6. Account suspension and termination

You can delete your account at any time from Dashboard → Settings. We can suspend or close an account for breaching these terms, fraudulent activity, or repeated valid reports from other users. Where reasonably possible, we'll tell you why.

7. Liability

To the extent permitted by law, Xhypee's liability to you is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms excludes or limits any consumer guarantee or right you have under the Australian Consumer Law that can't lawfully be excluded.

8. Changes to these terms

We may update these terms from time to time. Material changes will be reflected in the version date above; continuing to use Xhypee after a change means you accept the updated terms.

9. Governing law

These terms are governed by the laws of Queensland, Australia.
